Welcome to Cash Jobs Philly (“CJP”, “we”, “us”, or “our”). These Terms of Service (“Terms”) govern your access to and use of https://cashjobsphilly.com and any related features, tools, communications, or services (collectively, the “Site”). By accessing or using the Site, you agree to be legally bound by these Terms.

If you do not agree to these Terms, do not use the Site.


1. Platform Purpose and Nature of the Service

Cash Jobs Philly is a job-connection platform only. The Site provides a venue for individuals and businesses to post, discover, and communicate about short-term, temporary, informal, cash-based, W‑2, or 1099 job opportunities.

CJP is not:

  • an employer, co‑employer, joint employer, or employer of record;

  • a staffing agency, employment agency, recruiter, broker, or headhunter;

  • a payroll provider or payroll processor;

  • a payment processor, escrow service, or financial institution;

  • a benefits provider or insurer;

  • a guarantor of work, payment, safety, legality, or outcomes.

CJP does not hire, fire, supervise, manage, schedule, pay, train, insure, or control workers. All hiring, working, and payment decisions are made solely between users, using their own independent judgment.


2. No Agency, Fiduciary, or Employment Relationship

Nothing in these Terms or on the Site creates any partnership, joint venture, agency, fiduciary, employment, or representative relationship between CJP and any user, or between users themselves.

You may not represent or imply that CJP endorses, recommends, vets, approves, employs, represents, or guarantees any user, job, worker, employer, posting, or outcome.


3. User Eligibility

  • You must be at least 18 years old to use the Site.

  • No minors are permitted to register, post, apply, communicate, or otherwise use the Site.

  • By using the Site, you represent and warrant that you meet all eligibility requirements and have legal capacity to enter into these Terms.


4. User Responsibilities and Assumption of Risk

You understand and agree that:

  • You are solely responsible for vetting jobs, workers, employers, locations, terms, and conditions before proceeding.

  • You assume all risks associated with meeting, working for, hiring, or paying another user, including risks of injury, illness, theft, fraud, non‑payment, misrepresentation, harassment, discrimination, or illegal conduct.

  • CJP does not and cannot monitor job sites, physical locations, or real‑world interactions.

Employer Responsibilities

If you post or offer work, you are solely responsible for:

  • compliance with all applicable wage and hour laws;

  • minimum wage, overtime, and payroll requirements;

  • worker classification (employee vs. independent contractor);

  • payroll taxes, withholding, reporting, and remittance;

  • workers’ compensation and other required insurance;

  • workplace safety, licensing, and legal compliance;

  • non‑discrimination, harassment, and employment laws.

Worker Responsibilities

If you accept work, you are solely responsible for:

  • verifying job details, safety, and payment terms;

  • compliance with tax obligations;

  • determining your classification and insurance needs;

  • protecting your own personal safety and property.


5. Screening, Monitoring, and Enforcement

CJP may review, screen, or moderate job posts and user content for compliance with these Terms, but has no obligation to do so.

Any screening or removal does not constitute approval, endorsement, or verification.

Reporting tools are not emergency services and do not guarantee removal of content.


6. User Content and Section 230 Protection

CJP is an interactive computer service under Section 230 of the U.S. Communications Decency Act.

  • Users are solely responsible for all content they post, submit, or transmit.

  • CJP is not the publisher or speaker of user content.

  • CJP may remove, restrict, or refuse content at its sole discretion, with or without notice.

User content may be inaccurate, misleading, illegal, or offensive. You use the Site at your own risk.

CJP may disclose user content or account information to comply with law, legal process, or to protect users, CJP, or the public.


7. License to User Content

By submitting content, you grant CJP a non‑exclusive, worldwide, royalty‑free license to host, display, reproduce, distribute, modify, reformat, and promote such content solely in connection with operating and marketing the Site.

You represent that you have the rights to grant this license.


8. Communications, Messaging, and Notifications

Any messaging, email, or SMS features are provided as a courtesy only.

CJP does not guarantee:

  • delivery, receipt, or reading of messages;

  • timeliness or accuracy of notifications;

  • uninterrupted communication services.

You must independently follow up and confirm all job details.

Third‑party service failures (hosting, email, SMS, plugins, APIs) are not CJP’s responsibility.


9. Disclaimer of Warranties

THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE.”

TO THE FULLEST EXTENT PERMITTED BY LAW, CJP DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON‑INFRINGEMENT, AND ACCURACY.

CJP MAKES NO GUARANTEES REGARDING JOBS, USERS, PAYMENTS, SAFETY, LEGALITY, AVAILABILITY, OR OUTCOMES.


10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW:

  • CJP SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES.

  • CJP SHALL NOT BE LIABLE FOR INJURY, DEATH, PROPERTY DAMAGE, LOST WAGES, LOST PROFITS, OR DATA LOSS.

CJP’S TOTAL AGGREGATE LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF:

  • $100, OR

  • THE AMOUNTS PAID BY YOU TO CJP IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM.


11. Indemnification

You agree to defend, indemnify, and hold harmless CJP from any claims, damages, losses, liabilities, costs, or expenses (including attorneys’ fees) arising from:

  • your use of the Site;

  • your content or communications;

  • jobs you post or accept;

  • payroll, wage, tax, classification, insurance, or safety violations;

  • disputes with other users;

  • violation of law or these Terms.


12. Payments

CJP does not process job payments and is not involved in transactions between users.

CJP may offer paid subscriptions or features. All fees are non‑refundable unless expressly stated otherwise.


13. AI‑Generated Content (Current or Future Use)

CJP may use automated tools or artificial intelligence to assist with content generation, moderation, or platform operations.

AI‑generated content is provided “as is.” You are solely responsible for reviewing, adopting, and using such content.

AI tools do not create contracts, guarantees, or legally binding commitments.


14. Suspension and Termination

CJP may suspend or terminate accounts at any time, for any reason or no reason, without notice or liability.

You may stop using the Site at any time.


15. Arbitration Agreement

Except where prohibited by law, any dispute arising out of or relating to the Site or these Terms shall be resolved by binding arbitration, not in court.

  • Small claims court actions are permitted.

  • The arbitration shall be conducted under the Federal Arbitration Act.

  • Arbitration shall occur in Pennsylvania unless otherwise required by law.

YOU WAIVE THE RIGHT TO A JURY TRIAL.


16. Class Action Waiver

ALL CLAIMS MUST BE BROUGHT ON AN INDIVIDUAL BASIS. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION.


17. Governing Law and Venue

These Terms are governed by the laws of the Commonwealth of Pennsylvania.

If arbitration does not apply, disputes shall be resolved exclusively in state or federal courts located in Philadelphia County, Pennsylvania.


18. Force Majeure

CJP is not liable for delays or failures caused by events beyond its reasonable control.


19. DMCA Copyright Policy

CJP respects intellectual property rights and will respond to valid DMCA notices.


20. Changes to These Terms

CJP may update these Terms at any time. Continued use constitutes acceptance of the updated Terms.
